Legislative Drafting Careers: Working on Laws in Government Departments

Oct 7
7 min read

Every law a court applies began as a draft on someone's desk. Before a bill reaches the National Assembly or the Provincial Assembly of the Punjab, a drafter has turned a policy idea into sections, definitions and provisos. After the bill becomes an Act, drafters are at work again on the rules and regulations that make it workable. Most law students never meet these people, yet a drafter's choice of a single word can decide a case years later.

Legislative drafting is a quiet career inside government, but it suits LL.B graduates who enjoy precise writing and careful reading more than courtroom argument. This guide explains what drafters do, where drafting happens in Pakistan and how the posts are filled. It also covers the skills that matter and how you can start preparing while you are still a student or a junior advocate.

What legislative drafting actually involves

Legislative drafting is the work of writing laws: bills, ordinances and the subordinate legislation made under them, such as rules, regulations, bye-laws and notifications. A drafter rarely decides policy. The ministry or department that wants the law decides what it should achieve. The drafter's job is to express that aim in language that fits the Constitution and the existing statute book, and that is hard to misread.

The work falls into a few recurring tasks:

  • Drafting from instructions. Turning a policy proposal into a complete text, with definitions, operative provisions, offenses and penalties where needed, and commencement, repeal and savings clauses.

  • Scrutiny and vetting. Checking drafts prepared by other departments for constitutional competence, conflict with existing laws, internal consistency and form.

  • Amending existing laws. Writing amendments that fit into an Act without breaking its numbering, cross-references or definitions.

  • Subordinate legislation. Checking that rules and regulations stay within the power the parent Act gives. Our explainer on delegated legislation in Pakistan shows why this check matters so much.

  • Support while a bill is debated. Explaining a draft to a standing committee and redrafting clauses the committee wants changed.

Where drafting happens in Pakistan

Drafting is spread across several institutions, and each offers a slightly different kind of work.

  • Federal Ministry of Law and Justice. The Law and Justice Division has a Drafting and Legislation Wing. The ministry's own yearbook describes its work as scrutinizing, vetting and, where needed, drafting principal and subordinate legislation received from ministries and divisions, and assisting the standing committees of both Houses. For 2020-21 alone, it recorded more than 4,000 receipts sent for vetting, mostly subordinate legislation.

  • Punjab Law and Parliamentary Affairs Department. Under the Punjab Government Rules of Business, 2011, this department's business includes drafting bills, ordinances, rules, regulations and bye-laws, and scrutinizing draft bills before they go to the Assembly. Other departments must consult it on substantive legislation and on delegated legislation.

  • Assembly secretariats. The National Assembly Secretariat's organogram shows a Legislation Branch along with drafting posts. The Senate set up a Legislative Drafting Unit in 2017 to help senators turn their ideas into private members' bills and amendments. The Provincial Assembly of the Punjab has set out plans for a legislative drafting and research clinic to support its members.

  • Regulators. Statutory bodies make regulations under powers in their own laws. The Securities and Exchange Commission of Pakistan (SECP), for example, regularly publishes draft regulations for public comment before finalizing them. Legal staff in such bodies draft, revise and explain those texts.

How a draft moves through government

The federal Rules of Business, 1973 set the basic path. Under rule 27, the ministry that wants a bill first obtains the Cabinet's approval of the issues involved. It then asks the Law and Justice Division to draft the bill, sending a memorandum on the intended provisions and their objects and reasons. The draft returns to the Cabinet for approval before it goes to Parliament. Rule 30 applies the same procedure, with necessary changes, to ordinances. Rule 14 requires the Law and Justice Division to be consulted before rules, regulations, bye-laws or notifications are issued under statutory powers.

In simplified form, the federal cycle looks like this:

  1. Proposal. The administrative ministry works out the policy and prepares a summary.

  2. Approval in principle. The Cabinet approves the proposal.

  3. Drafting or vetting. The Law and Justice Division drafts the bill or vets the ministry's draft.

  4. Approval of the draft. The draft goes back to the Cabinet, then to Parliament.

  5. Parliamentary stages. Committees examine the bill and may amend it, and drafters help with the wording. Our guide on how laws are made in Pakistan, from bill to Act explains these stages.

  6. Rules under the Act. Once the Act is in force, the rules and regulations made under it go through vetting again.

In Punjab, the Rules of Business, 2011 give the Law and Parliamentary Affairs Department the equivalent consulting role, and the details of the provincial procedure are set out in those rules. For a drafter, the lesson is that most of the work arrives as someone else's draft, not as a blank page.

Typical posts and how they are filled

The Ministry of Law and Justice lists posts in its Drafting and Legislation Wing with titles such as Draftsman, Additional Draftsman, Deputy Draftsman and Assistant Draftsman. The National Assembly Secretariat's organogram also shows Draftsman, Additional Draftsman and Deputy Draftsman posts. The senior titles come after many years; a young graduate should look at the junior end of these structures.

How these posts are filled depends on the employer and its recruitment rules:

  • Federal posts. The Federal Public Service Commission (FPSC) recruits for the Federal Government through its general recruitment advertisements. Depending on the recruitment rules for a post, it may instead be filled by promotion or transfer, so not every vacancy is advertised.

  • Punjab posts. Provincial posts are generally advertised through the Punjab Public Service Commission (PPSC).

  • Assembly secretariats and regulators. These bodies recruit under their own rules and publish their own advertisements.

We have deliberately not quoted pay scales, age limits or experience requirements, because they change from one advertisement to the next. Read the current FPSC, PPSC or employer advertisement for the exact post title, scale, qualification, experience, age limit and domicile rules. If you hold an advocate's license, check with the bar council how a full-time salaried government post affects your practice before you accept it.

Skills that make a good drafter

The Legislative Drafting Manual published by the Pakistan Institute for Parliamentary Services (PIPS) in 2019 is a useful guide to what the work demands. Its points match what the job asks of you every day:

  • Plain, precise writing. Short sentences, one idea per provision, no colloquial phrases and no decoration. A section should mean one thing to every reader.

  • Statutory interpretation. You need to know how courts will read your words. The manual lists command of the General Clauses Act, 1897 and the principles of interpretation among the basic requirements.

  • Consistency. The manual warns that "change in language means change in intention." If a draft says "vehicle" in one section and "motor car" in the next, a court may assume two different things were meant.

  • Research. A drafter checks the Constitution, the existing statute book, relevant case law and any international convention Pakistan has ratified before writing a word.

  • Bilingual care. The Ministry of Law's wing also handles translation of legal texts from English into Urdu, so clean legal Urdu is an asset.

  • Patience with departments. Officers who bring a proposal often know the policy but not the law. Asking the right questions about what they actually want is half the job.

How an LL.B graduate can prepare

Nobody walks out of an LL.B as a finished drafter. You can, however, build the habits that make you a strong candidate:

  1. Read statutes, not only notes. Study how an Act is built: short title, definitions, operative sections, offenses, rule-making power, repeal and savings. Use official text; our guide to finding authentic Pakistani statutes and judgments shows where to look.

  2. Master the General Clauses Act, 1897. Drafters rely on its definitions and rules of construction every day.

  3. Practice redrafting. Take a long, confusing section of a familiar law and rewrite it in shorter provisions without changing its meaning. Our legal writing and editing exercises are a good place to build this skill.

  4. Read the PIPS manual. It is written for Pakistani conditions and covers the drafting conventions you will meet in government.

  5. Compare drafts with final texts. When a regulator publishes a draft for comment, keep it and compare it with the version that is finally notified. Ask why each change was made.

  6. Choose early work that involves drafting. Constitutional and service matters, corporate documents, and research or internship roles with government bodies all build relevant judgment.

  7. Watch the advertisements. Check FPSC and PPSC regularly and prepare seriously for the written test and interview when a suitable post appears.

Common drafting mistakes

  • Elegant variation. Using different words for the same thing to avoid repetition. In legislation, repetition is a virtue.

  • Loose definitions. Defining a term and then using it inconsistently, or defining terms the text never uses.

  • Broken cross-references. Amending one section and forgetting that three others refer to its old numbering.

  • Rules beyond the parent Act. Drafting a rule that goes further than the power the Act gives, which invites a challenge in court.

  • Ignoring the existing statute book. Creating a conflict with another law, or forgetting to repeal or amend the old provision.

  • Copying foreign models. Lifting a section from another country's law without adapting its terms and institutions to Pakistan.

  • Missing transitional provisions. Leaving pending cases, existing licenses or ongoing proceedings without clear rules once the new law starts.

Frequently asked questions

What does a legislative drafter do in Pakistan?

A legislative drafter writes and checks bills, ordinances and subordinate legislation such as rules and regulations. In government, much of the work is vetting drafts sent by other departments for constitutional competence, consistency and form. Drafters also help standing committees with wording while bills are under debate.

How are legislative drafting posts in government filled?

Federal posts are usually filled through FPSC general recruitment or, under some recruitment rules, by promotion or transfer, while Punjab posts are generally advertised through PPSC. Assembly secretariats and regulators recruit under their own rules. Qualifications, scales and age limits vary, so always read the current advertisement.

Can I prepare for drafting work while I am still studying for my LL.B?

Yes. Read statutes closely, learn the General Clauses Act, 1897, practice rewriting complicated provisions in plain language and study the PIPS Legislative Drafting Manual. Choosing internships and early jobs that involve drafting will strengthen your profile further.

Legislative drafting will not bring you the public profile of a courtroom career, but its influence is wide. A well-drafted section saves years of litigation, and a careless one creates it. If you enjoy getting words exactly right, this is a career where that habit is the whole point.

About this guide: the facts in this article were checked in October 2026 against the Ministry of Law and Justice's yearbook and wing pages, the federal Rules of Business, 1973 and the Punjab Government Rules of Business, 2011. We also checked the National Assembly and Senate websites, the Provincial Assembly of the Punjab's website, SECP press releases and the PIPS Legislative Drafting Manual (2019). Structures and recruitment rules change, so confirm the current position with the relevant department or commission before you rely on it.
